1. Acceptance of Terms

By accessing and using KDJ Hosting's web hosting services, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site and our services.

2. Service Description

KDJ Hosting provides web hosting services including shared hosting, domain registration, and related services. We reserve the right to modify, suspend, or discontinue any service at any time without notice.

2.1 Service Availability

• Services are provided on an "as is" and "as available" basis
• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Planned maintenance will be announced when possible

2.2 Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old or have parental consent to use our services

3. Payment Terms

3.1 Billing Cycle

Services are billed on monthly, annual, or other pre-determined cycles as selected during sign-up. Invoices are generated 14 days before the renewal date.

3.2 Payment Methods

We accept payments via Bank Transfer and Stripe (Credit Card). All payments must be made in the currency specified on your invoice.

3.3 Late Payments

• Payments not received by the due date are considered late
• Late fees of 2.00% will be applied to overdue invoices
• Late fees will be assessed after 15 days from the due date
• Services will be automatically suspended for non-payment after 5 days past due
• Accounts will be terminated for non-payment after 25 days past due
• Terminated accounts will lose all data permanently

3.4 Auto-Unsuspend

Suspended accounts will be automatically unsuspended upon full payment of all outstanding invoices.

3.5 Refunds

No refunds will be provided for any services purchased, including hosting, domains, or add-ons. All sales are final. Domain registration fees and any other services are non-refundable once purchased or activated.

4. Domain Services

4.1 Domain Registration

• Domain registrations are subject to registry policies and terms
• You agree to provide accurate contact information for WHOIS
• Domain fees are non-refundable once registered
• Domain auto-renewal is enabled by default unless disabled

4.2 Domain Transfer

Domain transfers must be initiated at least 15 days before expiration to avoid service interruption.

5. Acceptable Use Policy

5.1 Prohibited Content

The following content and activities are strictly prohibited:

• Illegal activities, including hacking, fraud, and phishing
• Copyright infringement, including software piracy and illegal downloads
• Adult content, pornography, and sexually explicit material
• Hate speech, discrimination, or harassing content
• Spam, bulk email, and unsolicited commercial communications
• Malware, viruses, or malicious scripts
• Proxy services, anonymizers, or TOR exit nodes
• File hosting, storage, or distribution services

5.2 Resource Usage

• Accounts using excessive CPU, memory, or I/O resources may be suspended
• File storage is for website files only (no backups, archives, or media libraries)
• Background processes and cron jobs must be reasonable in frequency
• Email sending is limited to 100 emails per hour per account

6. Privacy and Data Protection

6.1 Data Collection

We collect personal information necessary to provide our services, including name, email address, payment information, and website content.

• We implement appropriate security measures to protect your data
• We do not sell, rent, or share your personal information with third parties
• We may disclose information if required by law or to protect our rights

We use cookies and similar technologies to improve your experience and for analytics purposes.

7. Security and Access

7.1 Account Security

• You are responsible for maintaining strong password security
• Enable two-factor authentication where available
• Report unauthorized access immediately
• Do not share your login credentials with others

7.2 Server Security

We monitor for security threats and may suspend accounts posing security risks to our network or other customers.

8. Intellectual Property

8.1 Your Content

You retain all rights to content you upload to our servers. By using our service, you grant us a license to host, reproduce, and distribute your content as necessary to provide the service.

8.2 Our Content

All KDJ Hosting branding, designs, and proprietary materials remain our property and may not be used without permission.

9. Service Suspension and Termination

9.1 Suspension Timeline

Non-Payment Suspension:

• Day 0: Invoice due date
• Day 5: Services automatically suspended
• Day 25: Services terminated
• Day 55: All data permanently deleted

Other Suspension Reasons: We may suspend your account immediately for:

• Violation of these Terms of Service
• Security concerns or suspicious activity
• Excessive resource usage
• Abuse complaints or legal requests

9.2 Termination

We may terminate your account immediately for:

• Severe violations of these terms
• Illegal activities
• Repeated violations after suspension
• Non-payment (after 30 days of suspension)

9.3 Data Retention

Terminated accounts will have their data deleted within 30 days unless legal requirements dictate otherwise.

10. Affiliate Program

10.1 Program Details

• Affiliate commission: 6% of referred payments
• Commission delay: 5 days after payment is received
• Minimum payout: $10.00
• Commissions are paid via selected payment method

10.2 Affiliate Restrictions

• No self-referrals allowed
• Affiliate must be in good standing
• We may terminate affiliate accounts for abuse

11. Support Services

11.1 Support Availability

• Support is available via ticket system and live chat
• Response times vary by issue priority
• Emergency support may have additional fees

11.2 Support Scope

Support covers hosting-related issues. Third-party software, custom development, and website design assistance may incur additional charges.

12. Backups and Data Recovery

12.1 Backup Policy

• We perform automated weekly backups of customer accounts every Sunday
• We maintain 4 weekly backups (4 Sundays) for disaster recovery
• Backup retention: 28 days (4 weeks)
• Backups are for disaster recovery purposes only
• Customers should maintain their own regular backups
• Backup restoration must be requested manually through:
• • Submitting a support ticket via the client area
• • Contacting our WhatsApp support number
• Backup restoration may incur fees depending on the request
• We do not guarantee backup availability or integrity
• Point-in-time restores are not available - only full account restores
• Backup requests will be processed within 24-48 hours

13. Service Level Agreement

13.1 Uptime Guarantee

While we strive for maximum uptime, we do not offer a formal uptime guarantee. Service credits may be provided at our discretion for extended outages.

13.2 Maintenance

Planned maintenance will be scheduled to minimize impact but may cause temporary service interruptions.

14. Limitation of Liability

14.1 Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, whether express or implied.

14.2 Limitation of Damages

KDJ Hosting shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or data, arising from your use of our services.

14.3 Maximum Liability

Our total liability for any claim related to our services shall not exceed the amount you paid for the service in the preceding 3 months.

15. Indemnification

You agree to indemnify and hold KDJ Hosting harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.

16. Force Majeure

We are not liable for failures or delays due to circumstances beyond our reasonable control, including natural disasters, wars, terrorism, or government actions.

17. Governing Law and Jurisdiction

These terms are governed by the laws of Sri Lanka. Any disputes will be resolved in the courts of Sri Lanka.

18. Changes to Terms of Service

We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of any changes.

19. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These terms, along with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and KDJ Hosting.
